Established under an act of Congress, the Clearinghouse helps employers identify drivers who may have violated drug and alcohol policies while working for one company and failed to disclose the violation to another employer, as required. Improving Highway Safety

The Clearinghouse equips FMCSA, SDLAs, and employers with the essential tools to identify drivers prohibited from operating a commercial motor vehicle (CMV) due to violations of the U.S. Department of Transportation (DOT) drug and alcohol program. It also ensures that these drivers complete the necessary evaluation and treatment before being allowed to operate a CMV on public roads.

The First Clearinghouse Rule

The initial Clearinghouse final rule mandates that FMCSA-regulated employers, medical review officers (MROs), substance abuse professionals (SAPs), and consortia/third-party administrators (C/TPAs) report any violations of drug and alcohol regulations, as outlined in 49 Code of Federal Regulations Parts 40 and 382, involving current or prospective employees.

Additionally, the rule requires the following:
1. Employers are required to query the Clearinghouse for current and prospective employees’ drug and alcohol violations before permitting those employees to operate a CMV on public roads.
2. Employers are required to annually query the Clearinghouse for each driver they currently employ.
