FMCSAPRO, along with its affiliates and joint ventures, provides services in the transportation industry, including Department of Transportation (DOT) compliance services (referred to throughout as “Services”). FMCSAPRO collects personal information from Customers (referred to throughout as “Customer”, “you”, “your”, and/or “user”) and visitors through our website and services (collectively referred to throughout as “the Platform”) and in connection with FMCSAPRO’s Services.
This Privacy Policy explains how and why FMCSAPRO might (“FMCSAPRO,” “we,” “us,” or “our”) use, collect, store, and/or share your information when you access the Platform or use our Services, as well as the choices you have regarding it and how you can contact FMCSAPRO with any questions or concerns. FMCSAPRO is committed to full compliance with all applicable privacy laws. If you think you have additional rights in your region, state, or jurisdiction, please contact FMCSAPRO.

1. TYPES OF INFORMATION FMCSAPRO COLLECTS
FMCSAPRO collects personal information that you provide to us when you register on the Platform, provide your USDOT Number, express an interest in obtaining information about FMCSAPRO or our products and services, participate in activities on the Platform, subscribe for our Services, or otherwise contact us. The personal and company information that FMCSAPRO collects depends on the context of your interactions with us, the services selected, the options you exercise, and the features you use.
The personal information FMCSAPRO collects may include the following:
- a. Name and phone numbers
- b. Email, billing, and mailing addresses
- c. Job and company titles
- d. Usernames and passwords
- e. Contact preferences, contact and authentication data
- f. Debit card and credit card numbers
- g. USDOT number and company name
- h. Driver’s license number and vehicle tag number
All personal, billing, and company information that you provide to FMCSAPRO must be true, complete, and accurate, and you must notify FMCSAPRO of any changes to such personal and company information. FMCSAPRO is not responsible for the consequences of the provision of incorrect, incomplete, or fraudulent information.
2. INFORMATION AUTOMATICALLY COLLECTED – FMCSAPRO automatically collects certain information when you visit, use, or navigate the Platform. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the Platform, and other technical information. This information is primarily needed to maintain the security and operation of the Platform and our Services, and for our internal analytics and reporting purposes. The types of information FMCSAPRO collects includes:
a. Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use the Platform and which FMCSAPRO records in log files. Depending on how you interact with FMCSAPRO, this log data may include your IP address, device information, browser type, and settings and information about your activity on the Platform (such as the date/time stamps associated with your usage, pages, and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (“crash dumps”), and hardware settings).
b. Device Data. FMCSAPRO collects device data such as information about your computer, phone, tablet, or other device you use to access the Platform. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
c. Location Data. FMCSAPRO collects location data such as information about your device’s location, which can be either precise or imprecise. How much information FMCSAPRO collects depends on the type and settings of the device you use to access the Platform. For example, FMCSAPRO may use GPS and other technologies to collect geolocation data that tells FMCSAPRO your current location (based on your IP address). You can opt out of allowing FMCSAPRO to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Platform.
3. PROCESSING OF INFORMATION – FMCSAPRO processes your personal information for a variety of reasons, depending on how you interact with the Platform, including:
a. To enable you to create, authenticate, and log in to your account.
b. To manage and keep your account in working order.
c. To fulfill and manage your orders and to provide the requested Service(s).
d. To respond to inquiries and solve any potential issues with the Service(s).
e. To send you details about our Services, changes to our terms and policies, and other similar or administrative information.
f. FMCSAPRO processes your USDOT number to obtain available information from the U. S. Department of Transportation website.
g. To process payments and returns made through the Platform.
4. LEGAL BASES ACCORDING TO JURISDICTION – If you are located in Canada, this section applies to you. FMCSAPRO may process your information if you have given FMCSAPRO specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time. In some exceptional cases, FMCSAPRO may be legally permitted under applicable law to process your information without your consent, including, for example:
a. If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way.
b. For investigations and fraud detection and prevention.
c. For specified business transactions provided certain conditions are met.
d. If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim.
e. For identifying injured, ill, or deceased persons and communicating with next of kin.
f. If FMCSAPRO has reasonable grounds to believe an individual has been, is, or may be victim of financial abuse.
g. If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.
h. If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.
i. If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced.
j. If the collection is solely for journalistic, artistic, or literary purposes.
k. If the information is publicly available and is specified by the regulations.
5. SHARING INFORMATION – FMCSAPRO may share your personal information in the following situations:
a. Business Transfers. FMCSAPRO may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
b. Affiliates. FMCSAPRO may share your information with our affiliates, in which case FMCSAPRO will require those affiliates to honor this privacy policy notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that FMCSAPRO controls or that are under common control with FMCSAPRO.
c. Business Partners. FMCSAPRO may share your information with our business partners to offer you certain products, services, or promotions.
6. THIRD-PARTY WEBSITES
The Platform and/or Services provided by FMCSAPRO may link to third-party websites, online services, or mobile applications, and/or contain advertisements from third parties that are not affiliated with FMCSAPRO. These links may redirect you to other websites, services, or applications. FMCSAPRO does not make any guarantees regarding the content, security, or functionality of such third-party resources and will not be liable for any loss or damage resulting from their use.
The inclusion of a link to a third-party website, service, or application does not constitute an endorsement by FMCSAPRO. Additionally, FMCSAPRO cannot ensure the safety and privacy of any data you provide to third parties. Data collected by third parties is not covered under this Privacy Policy.
FMCSAPRO is not responsible for the content, privacy, or security practices of any third-party websites, services, or applications that may be linked to or from the Platform. You are encouraged to review the privacy policies of such third parties and reach out to them directly if you have questions or concerns.
7. COOKIES AND OTHER TRACKING TECHNOLOGIES
FMCSAPRO may use cookies and similar tracking technologies (such as web beacons and pixels) to access or store information. Specific details about how FMCSAPRO uses such technologies, as well as how you can manage or refuse certain cookies, are provided in our Cookie Notice referenced in Section 8.
8. INFORMATION RETENTION
FMCSAPRO will retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law (e.g., for tax, accounting, or legal compliance). When there is no ongoing legitimate business need to process your personal information, FMCSAPRO will either delete or anonymize the information. If deletion is not feasible (e.g., due to storage in backup archives), FMCSAPRO will securely store your information and isolate it from any further processing until deletion is possible.
9. PROTECTION OF INFORMATION
FMCSAPRO has implemented reasonable and appropriate technical and organizational measures to safeguard your personal information. While these measures aim to protect against unauthorized access, theft, or alteration, no internet-based transmission or storage system can be guaranteed 100% secure. FMCSAPRO cannot guarantee that hackers, cybercriminals, or other unauthorized entities will not overcome our security measures.
Transmission of personal information to and from the Platform is at your own risk. You should access the Platform only within a secure environment. FMCSAPRO is committed to continuously enhancing its security practices to protect your data.
10. NO COLLECTION OF INFORMATION FROM MINORS
You must be at least 18 years old to use the Platform or access FMCSAPRO’s Services. FMCSAPRO does not knowingly collect or solicit data from, or market to, individuals under the age of 18. By using the Platform, you confirm that you are at least 18 years old.
If FMCSAPRO becomes aware that personal information has been collected from a minor under the age of 18, we will take immediate steps to deactivate the account and delete such data from our records. If you suspect FMCSAPRO has collected information from a minor under 18, please notify us promptly at helpdesk@fmcsapro.com.
11. PRIVACY RIGHTS DEPENDING ON REGION – In some regions, you have certain rights under applicable data protection laws. No matter where you live, FMCSAPRO is committed to following all applicable data protection laws. If you believe you have additional privacy rights or protections, please contact FMCSAPRO by email at helpdesk@fmcsapro.com so that FMCSAPRO can comply with all applicable laws. The applicable data protection laws may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting FMCSAPRO at helpdesk@fmcsapro.com. FMCSAPRO will consider and act upon any request in accordance with applicable data protection laws.
a. Withdrawing Your Consent
If FMCSAPRO relies on your consent to process your personal information, whether express or implied (depending on applicable law), you have the right to withdraw your consent at any time. You can do so by contacting FMCSAPRO at helpdesk@fmcsapro.com. Please note that withdrawing consent will not affect the lawfulness of any processing conducted before its withdrawal, nor will it, where allowed by law, affect processing based on other lawful grounds.
b. Opting Out of Marketing and Promotional Communications
You can unsubscribe from FMCSAPRO’s marketing and promotional communications at any time by clicking the unsubscribe link in the footer of our emails or subscription renewal notices, or by contacting FMCSAPRO at helpdesk@fmcsapro.com. Once unsubscribed, you will be removed from our marketing lists. However, FMCSAPRO may still communicate with you for non-marketing purposes, such as regarding your subscription(s) or service(s), to respond to service requests, or for account-related administration.
c. Account Information
To review or update your account information, or to terminate your account, contact FMCSAPRO at helpdesk@fmcsapro.com. Upon receiving your termination request, FMCSAPRO will deactivate or delete your account and related information from our active databases. However, we may retain certain information as required by law or for legitimate business purposes, such as fraud prevention, troubleshooting, investigations, enforcement of legal terms, or compliance with applicable legal requirements.
d. Cookies and Similar Technologies
Most web browsers accept cookies by default. However, you can modify your browser settings to remove or reject cookies. Keep in mind that rejecting cookies may impact the functionality of some features or services on the Platform. You may also opt out of interest-based advertising displayed on the Platform by contacting FMCSAPRO at helpdesk@fmcsapro.com.
12. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, FMCSAPRO does not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that FMCSAPRO must follow in the future, FMCSAPRO will inform you about that practice in a revised version of this privacy policy notice.
13. CALIFORNIA RESIDENTS
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are California residents to request and obtain from FMCSAPRO, once a year and free of charge, information about categories of personal information (if any) FMCSAPRO disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which FMCSAPRO shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact FMCSAPRO at helpdesk@fmcsapro.com.
FMCSAPRO does not permit use by minors; however, under California law, if you are under 18 years of age, reside in California, and have a registered account, you have the right to request the removal of unwanted data that you publicly post on the Services. FMCSAPRO’s Services and the use of the Platform are not intended for minors, and upon learning or notification that a minor has registered an account, FMCSAPRO reserves the right to cancel and delete the account. To request the removal of such data, please contact FMCSAPRO at helpdesk@fmcsapro.com, including the email address associated with the account and a statement that you reside in California. FMCSAPRO will ensure the data is not publicly displayed on the Platform, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).
a. CCPA Privacy Notice – The California Code of Regulations defines a “resident” as:
- i. every individual who is in the State of California for other than a temporary or transitory purpose andii. every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.
b. Categories of personal information FMCSAPRO collects – California residents have the right to request that FMCSAPRO disclose the following information to you about our collection and use of your personal information over the past twelve (12) months. FMCSAPRO may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request.
Upon verification, we will disclose to you:
i. The categories of personal information we have collected about you.
ii. The categories of sources for the personal information we have collected about you.
iii. The specific pieces of personal information we have collected about you.
iv. Our business or commercial purpose for collecting or selling your personal information.
v. The categories of third parties to whom we have sold or shared your personal information, if any, and the categories of personal information that we have shared with each third-party recipient.
c. FMCSAPRO may also collect other personal information outside of these categories through instances where you interact with FMCSAPRO online, or by email in the context of receiving help through email at helpdesk@fmcsapro.com; participation in customer surveys or contests; and facilitation in the delivery of our Services and responses to your inquiries.
d. Authorized Agents and Verification Requirements – If you are using an authorized agent to exercise your right to opt-out, FMCSAPRO may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.
e. When your information may be shared – FMCSAPRO may disclose your personal information with our service providers pursuant to a written contract between FMCSAPRO and each service provider. Each service provider is a for-profit entity that processes the information on our behalf, following the same strict privacy protection obligations mandated by the CCPA. FMCSAPRO may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be the “selling” of your personal information. FMCSAPRO has not sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.
f. Your right to request deletion of the data – You can ask for the deletion of your personal information. If you ask FMCSAPRO to delete your personal information, FMCSAPRO will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of their right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.
g. Removal of Personal Information – In accordance with applicable law, FMCSAPRO is not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.
h. Non-Discrimination for the Exercise of Privacy Rights – FMCSAPRO will not discriminate against you if you exercise your privacy rights.
i. Verification process – Upon receiving your request, FMCSAPRO will need to verify your identity to determine you are the same person about whom FMCSAPRO has the information in our system. These verification efforts require FMCSAPRO to ask you to provide information so that FMCSAPRO can match it with information you have previously provided FMCSAPRO. For instance, depending on the type of request you submit, FMCSAPRO may ask you to provide certain information so that FMCSAPRO can match the information you provide with the information FMCSAPRO already has on file, or FMCSAPRO may contact you through a communication method (e.g., phone or email) that you have previously provided to FMCSAPRO. FMCSAPRO may also use other verification methods as the circumstances dictate.
j. FMCSAPRO will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, FMCSAPRO will avoid requesting additional information from you for the purposes of verification. However, if FMCSAPRO cannot verify your identity from the information already maintained by FMCSAPRO, FMCSAPRO may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. FMCSAPRO will delete such additionally provided information as soon as FMCSAPRO finishes the process of verifying your identity.
k. Other privacy rights
i. You may object to the processing of your personal information.
ii. You may request correction of your personal data if it is incorrect or no longer relevant or ask to restrict the processing of the information.
iii. You can designate an authorized agent to make a request under the CCPA on your behalf. FMCSAPRO may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
iv. You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an optout request, FMCSAPRO will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

14. NEVADA RESIDENTS – Under Nevada law, certain Nevada residents may opt out of the sale of “personally identifiable information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. FMCSAPRO does not engage in such activity; however, if you are a Nevada resident who has placed orders for Service(s) from FMCSAPRO, you may submit a request to opt out of any potential future sales under Nevada law by emailing FMCSAPRO at helpdesk@fmcsapro.com. Please note FMCSAPRO will take the requisite reasonable steps to verify your identity and the authenticity of the request. Once verified, FMCSAPRO will maintain your request in the event FMCSAPRO’s practices change.
15. VIRGINIA RESIDENTS – Virginia CDPA Privacy Notice – Under the Virginia Consumer Data Protection Act (CDPA):
“Consumer” means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.
“Personal data” means any information that is linked or reasonably linkable to an identified or identifiable natural person. “Personal data” does not include de-identified data or publicly available information.
“Sale of personal data” means the exchange of personal data for monetary consideration.
If this definition “consumer” applies to you, FMCSAPRO must adhere to certain rights and obligations regarding your personal data. The information FMCSAPRO collects, use, and disclose about you will vary depending on how you interact with FMCSAPRO and our Services. Your rights with respect to your personal data:
a. Right to be informed whether or not FMCSAPRO are processing your personal data.
b. Right to access your personal data.
c. Right to correct inaccuracies in your personal data.
d. Right to request deletion of your personal data.
e. Right to obtain a copy of the personal data you previously shared with FMCSAPRO .
f. Right to opt out of the processing of your personal data if it is used for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (“profiling”).
FMCSAPRO does not “sell” personal information as that word is traditionally defined. However, FMCSAPRO does share personal information with third parties to provide personalized advertising. Through the use of cookies, certain personal information may be made available to third parties. This is the “targeting” that you may opt-out from under Virginia law.
Exercise your rights provided under the Virginia CDPA – You can opt out from the selling of your personal data, targeted advertising, or profiling by disabling cookies in Cookie Preference Settings. You may contact FMCSAPRO by email at helpdesk@fmcsapro.com. If you are using an authorized agent to exercise your rights, FMCSAPRO may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.
Verification process – FMCSAPRO may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, FMCSAPRO may need to collect additional information to verify your identity before processing your request. Upon receiving your request, FMCSAPRO will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. FMCSAPRO will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.
16. UPDATES TO THIS PRIVACY POLICY NOTICE – FMCSAPRO may update this privacy policy notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If FMCSAPRO makes material changes to this privacy policy notice, FMCSAPRO may notify you either by posting a notice of such changes or by directly sending you a notification. FMCSAPRO encourages you to review this privacy policy notice frequently to be informed of how FMCSAPRO is protecting your information.
17. REVIEW, UPDATE, OR DELETE THE DATA FMCSAPRO COLLECTS – Based on the applicable laws of your state or country of residence, you may have the right to request access to the personal information FMCSAPRO collects from you, change that information, or delete it. To request to review, update, or delete your personal information, please contact FMCSAPRO by email at helpdesk@fmcsapro.com.
18. EXCEPTIONS TO APPLICATION – Please note that this Privacy Policy does not apply to information provided to FMCSAPRO for employment or potential employment screening purposes, which is governed by the Fair Credit Reporting Act and other related statutes.
19. TYPES OF DATA COLLECTED – FMCSAPRO may collect information about your interactions with the Platform, such as the pages you visit, the links you click on, and the actions you take while using the Platform. This information may be used to improve the user experience, to analyze how the Platform is being used, and to personalize content and advertisements on the Platform. Additionally, FMCSAPRO may use various technologies to collect this information, including cookies and web beacons. A cookie is a small data file that is stored on your device when you visit a website, and a web beacon is a small transparent image file that is used to track your browsing activity. These technologies may be used to track your activities across the Platform and online services, and to store your preferences and other information.
20. DATA SHARING – FMCSAPRO may share your personal information with FMCSAPRO’S employees, independent contractors, representatives, agents, affiliates, corporate parent, subsidiaries, and any other affiliates for purposes consistent with this Privacy Policy.
21. STATISTICS – FMCSAPRO may share aggregated benchmarking statistics with Customers about drivers in the industry, such as the average number of years that drivers stay in the same position.
22. SERVICE PROVIDERS – FMCSAPRO may share your personal information with companies and individuals that provide services on FMCSAPRO’s behalf or help FMCSAPRO operate FMCSAPRO’s Services, the Platform or FMCSAPRO’s business. This includes hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, fraud detection, investigation and prevention services, web and mobile analytics, email and communication distribution and monitoring services, session or activity recording services, call recording, analytics and transcription services, event production and hosting services, remote access services, performance measurement, data optimization and marketing services, support and customer relation management systems, and third-party customer support providers.
23. THIRD PARTY COMPANIES – FMCSAPRO may share your personal information with third party advertising companies (including the interest-based advertising purposes described above), lead generation partners, and channel partners, resellers, and distributors that allow FMCA to explore and pursue growth opportunities.
24. PROFESSIONAL ADVISORS – FMCSAPRO may share your personal information with professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to FMCSAPRO.
25. GOVERNMENT AUTHORITIES – FMCSAPRO may share personal information with law enforcement, government authorities, and private parties, as required by law or as FMCSAPRO believes, in good faith, to be necessary or appropriate.
26. CORPORATE STATUS CHANGE – In the event of a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, FMCSAPRO’s company or affiliates (including, in connection with a bankruptcy or similar proceedings), FMCSAPRO may share personal information with acquirers and other relevant parties.
27. QUALITY CONTROL AND LIVE ON-SCREEN ASSISTANCE
1) Monitoring and Recording – FMCSAPRO may monitor and/or record any communications between you and FMCSAPRO (or FMCSAPRO’s Service Providers) for quality control, service help and other permitted business purposes. This monitoring or recording may be done without any further notice to you or anyone acting on your behalf.
2) Co-Browsing – CoBrowse enables FMCSAPRO to view your active digital session in a limited capacity to provide you with live on-screen assistance while interacting with FMCSAPRO ‘s websites and digital services. FMCSAPRO will only be able to CoBrowse with you within the Platform and digital services and will not be able to view other applications on your device. This will not allow FMCSAPRO to gain control of your computer, unless specifically authorized and accepted by you. 3) ScreenShare – ScreenShare enables FMCSAPRO ‘s representatives or agents to view your active web session on the Platform with expanded access to provide you with live on-screen assistance while interacting with the Platform. This expanded access will enable the FMCSAPRO representative or agent to provide you with real-time assistance to respond to and/or address your needs. FMCSAPRO ‘s representatives or agents will not be able to see any open browser tabs, screens, and applications that are running in the background on your device. This will not allow FMCSAPRO to gain control of your computer, unless specifically authorized and accepted by you.
